Please read these Terms of Service ("Terms") carefully. They govern your use of the DARK CHATS AI service. By accessing or using the Service, you agree to be bound by these Terms and the DARK CHATS Privacy Policy.
1. Acceptance of Terms
By using the DARK CHATS Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Service.
2. Eligibility and Age Restriction
The DARK CHATS Service is intended solely for users who are eighteen (18) years of age or older.
Age Verification Required
By accessing or using the Service, you represent and warrant that you are 18 years of age or older. We reserve the right to terminate your access to the Service without warning if we believe you are under the age of 18 or if we suspect any misrepresentation of your age.
3. Prohibited Activities and Acceptable Use Policy
You agree to use the Service only for lawful purposes and in a manner that does not violate the rights of, or restrict or inhibit the use and enjoyment of the Service by, any third party.
You are strictly prohibited from using the Service to generate, transmit, or share any User Input Messages or content that:
- Is Illegal or Harmful: Promotes, facilitates, or participates in illegal activities, including but not limited to, criminal acts, violence, fraud, or the solicitation of minors.
- Encourages Self-Harm: Encourages or provides instructions on how to self-harm or commit suicide.
- Contains Hate Speech or Discrimination: Is defamatory, obscene, indecent, abusive, offensive, harassing, violent, hateful, inflammatory, or otherwise objectionable based on race, ethnicity, religion, gender, sexual orientation, disability, or any other legally protected characteristic.
- Infringes Intellectual Property: Violates any patent, trademark, trade secret, copyright, or other intellectual property or proprietary rights of any other person.
- Contains Personal Identifiable Information (PII): Includes or solicits personal data, private information, or confidential information belonging to yourself or others (e.g., names, addresses, phone numbers, or financial details), as this compromises our commitment to anonymity.
- Attempts to Compromise Security: Contains viruses, malware, or any other code designed to disrupt, damage, or limit the functionality of the Service or any computer hardware or software.
- Bypasses Safety Measures: Attempts to circumvent or manipulate any content filtering, safety, or security features implemented by DARK CHATS.
We reserve the right to immediately suspend or terminate your access to the Service without notice if we determine, in our sole discretion, that you have violated this Section 3.
4. Disclaimer of Liability
The Service is provided on an "as-is" and "as available" basis. While we strive to maintain a high-quality service, the AI technology is probabilistic in nature and may, at times, generate content that is inaccurate, incomplete, or offensive.
Important Notice
You acknowledge that any reliance you place on the output generated by the Service is strictly at your own risk.
DARK CHATS shall not be liable for any damages, whether direct, indirect, incidental, special, consequential, or punitive, arising out of your use of, or inability to use, the Service.
5. Intellectual Property
You retain all rights to the User Input Messages you provide to the Service. By providing Input Messages, you grant DARK CHATS a perpetual, worldwide, royalty-free, non-exclusive license to use, store, copy, modify, and analyze this data solely for the purpose of training and improving our AI models, as detailed in our Privacy Policy.
6. Termination
We may terminate or suspend your access to all or part of the Service immediately, without prior notice or liability, if you breach any of these Terms. Upon termination, your right to use the Service will immediately cease.
7. Changes to the Terms
We reserve the right to modify these Terms at any time. We will provide notice of any changes by updating the "Effective Date" at the top of these Terms. Your continued use of the Service after the posting of revised Terms means you accept and agree to the changes.
